These Terms govern your access to, usage of all content, Product and Services available at the FQM Entertainment Limited website (the "Service") operated by FQM Entertainment Limited ("us", "we", or "our"). These terms also cover the provision of digital marketing services, strategic timelines, payment terms, and other related conditions essential to campaign execution.
Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.
Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.
Intellectual Property & Campaign Assets
The Agreement does not transfer from Us to you any of Ours or third party intellectual property. All proprietary methodology, algorithms, software configurations, and internal strategic frameworks remain solely with FQM Entertainment Limited. Specific campaign assets (such as finalized ad copy, published content, and approved graphics) developed exclusively for the client will be transferred upon full payment of related invoices, as detailed in individual service contracts.
Provision of Digital Marketing Services
Timelines provided for SEO rankings, PPC campaign launches, and content generation are estimates based on standard operational parameters. Digital marketing is subject to third-party algorithm updates (e.g., Google, Meta). FQM Entertainment Limited reserves the right to adjust strategic timelines to maintain campaign integrity. Payment terms, retainer structures, and specific deliverable schedules will be strictly outlined in a formalized Statement of Work (SOW) prior to deployment.
Third-Party Services & Platforms
In using the Services, you may use third-party services, products, software, tracking scripts, or ad platforms developed by a third party ("Third-Party Services").
- Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services, including but not limited to sudden account bans or algorithm changes by search or social platforms.
- You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such websites or platforms.
Termination
We may terminate or suspend your access to all or any part of our digital platform at any time, with or without cause, with or without notice, effective immediately. All digital marketing service agreements regarding specific project timelines, deliverables, and payment obligations are governed by separate, formal contracts and subject to the termination clauses therein.
Disclaimer
Our Services are provided "AS IS." and "AS AVAILABLE" basis. FQM Entertainment Limited and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither FQM Entertainment Limited, nor its suppliers and licensors, makes any warranty that our Services will be error-free or that access thereto will be continuous or uninterrupted. Furthermore, we do not guarantee specific financial results or ROI, as digital marketing success relies heavily on external market variables.
